Law Minister In His Blog Said”My attempts to present the Communal Violence Bill for discussion and vote in the Rajya Sabha, were met with a series of allegations and counter-positions taken by the Opposition. What’s more, a statement of mine was taken out of context and attached to other issues, creating another diversion in the Upper House.Unfortunately, the barrage of noise forced the Hon’ble Speaker to defer the Bill. Leaving us, and the nation, in the lurch once again”
Congress Senior Leader Sibal Targeted Leader of the Opposition, Arun Jaitley and said” Leader of the Opposition, shri Arun Jaitley was quick to post his views opposing the Bill on his website later that afternoon. I am glad he did. Because we can now address the issue, point to point, and hope to take it up in a more Parliamentary manner, at a later date.
Here are my thoughts on the matter:
Minister Said “The Bill, however, enables the National Human Rights Commission to investigate what are defined as “Scheduled” offences only and only if State Governments give their concurrence. In any event, the Central Government has no role to play in such investigations.This country has witnessed the targeting of sections of society professing one religion or another. This country has witnessed State Governments unwilling to investigate offences committed during the course of such targeting. In fact, many courts, including the Supreme Court, have been constrained to comment that state investigating agencies have not only been laggard, but have willingly mis-directed their investigations to benefit the real accused.”
While Arguing Jaitely Sibal Said “The objection of the Leader of Opposition that Parliament lacks legislative competence to introduce Prevention of Communal Violence (Access to Justice and Reparations) Bill, 2014 is without substance.If the logic of the Leader of the Opposition were to be accepted then the Delhi Special Police Establishment Act, 1946 is also unconstitutional since it permits investigation of offences and classes of offences by the CBI with the consent of the State Government.
