Ram Jethmalani Failed To Get Stay On Defamation Case Against Delhi CM Arvind Kejriwal
A court today rejected the plea of Delhi Chief Minister Arvind Kejriwal to stay the proceedings in a criminal defamation case filed against him and five other AAP leaders by Union minister Arun Jaitley.
The application moved by senior advocate Ram Jethmalani on behalf of Kejriwal before Chief Metropolitan Magistrate Sumit Dass said there are two cases — one civil and the other criminal — filed against the AAP leaders on same allegations and one of them should be stayed.
“Adjourn the matter, so that I can approach the High Court in this regard… I don’t want to face both the cases simultaneously,” Jethmalani said.
The court, however, rejected the plea saying, “The matter has to proceed further… the application is dismissed. Put up for further hearing on July 16 for framing notice.”
The court, meanwhile, directed the complainant’s counsel to supply the copies of the documents, filed along with the complaint, to the accused persons.
“In the larger interest of justice and to cut short the controversy, copies be supplied today itself,” the court said.
The application seeking documents was moved by senior advocate H S Phoolka, appearing for one of the AAP leaders, who said that legible documents were not given to them.
Senior advocate Siddharth Luthra, appearing for Jaitley, however, claimed all the documents have been supplied to the accused persons (AAP leaders) and “they are just trying to delay the proceedings.The documents sought by the accused persons are not a part of the complaint.
He said, “They (accused) have come with a fictitious story that the copies were not complete,” and requested the court to conduct day-to-day proceedings in the case.
During the proceedings, Kejriwal, AAP leaders Kumar Vishwas and Raghav Chadha were present in the court room.
The court had on April 7 granted bail to Kejriwal and AAP leaders Ashutosh, Sanjay Singh, Vishwas, Chadha and Deepak Bajpai.
Jaitley had filed the criminal defamation complaint alleging Kejriwal and the five AAP leaders had allegedly defamed him in Delhi District Cricket Association (DDCA) controversy.
While recording his statement, Jaitley, who was the DDCA president from December 1999 to December 2013, said the claims against him and his family members lowered his dignity in the eyes of the public, adding their statements were false.
Jaitley had on December 21, 2015 filed the criminal defamation case against them and sought their prosecution for offences that entail a punishment of up to two years in jail.
Besides the criminal defamation case,
Jaitley has also filed a civil defamation suit before the Delhi High Court seeking Rs 10 crore in damages from Kejriwal and the five AAP leaders, for issuing allegedly false and defamatory statements against him and his family in connection with alleged irregularities in DDCA when he was its President

In a bid to scotch murmurs of a rift with the party leadership over his decision, Phoolka said that he would remain an “inherent” part of AAP, which he said is standing on the cusp of winning the next assembly polls in Punjab.

HS Phoolka To Paddle ,31 kms against Denial of Justice for 31 years In Delhi, On 11 April
After Earning Success In Punjab Against V V I P culture recently H.S. Phoolka Announces Cycle Rally On 11 April ,To Demand Justice, In Delhi The participants would present a memorandum to the PM. This event is organized by Human Rights Groups
In a bid to call attention of the civil society and the government in power, Human Rights Organizations and Sikh bodies would take embark on a unique way of protest by cycling through the streets of Delhi on the 11th of April, 2015 Saturday.
The 31 kms cycle rally is to protest against Denial of Justice for 31 years to the humanity and Sikh community in particular. H.S.Phoolka, would lead the cycle rally along with others.
3000 people according to the official figure were killed in Delhi within 48 hours in November 1984. Hardly anyone is awarded punishment.
Phoolka has alleged that Successive Governments keep on shielding the culprits.The missing chargesheets against Sajjan Kumar which was prepared and signed on 8 April 1992 for murder of 4 Sikhs has not been filed in the Court yet though 23 years have passed.
Phoolka says that Clean chit was discreetly given by CBI under the control of Modi led BJP government to Jagdish Tytler in December 2014. The recent development has enraged all right thinking citizens, the victims and the Sikh community in particular.
Mr. Phoolka and his team has been using cycling as a medium to make aware different issues to the people in the past too. He headed a cycling team which travelled 100kms against the VVIP culture in Punjab recently.

Phoolka Alleges That The govt. has no money to pay the salaries of its employees but are spending lavishly on their security and travel. The MLA’s have doubled their salaries but the old age pensions are still pending to be distributed to the people in need and the scholarships for differently-abled persons are also not paid.
Cyclist demands the implementation of the principle of lowest employee should be paid first. The ministers and minister’s staff should be paid after everyone else in the department is paid.
The rally is also against the increasing use of Drugs and the government’s failure to run De-Addiction centers properly.
