Make Judiciary an Essential Service: Kapil Sibal

(New Delhi) Make judiciary an essential service: Sibal
Congress leader Kapil Sibal on Saturday urged the judiciary to declare a plan to ensure that justice delivery system is made an essential service, noting that people were facing hardships due to restricted functioning of courts during the coronavirus lockdown.
He said the government cannot take such a decision as the judiciary is independent.
The Congress leader, who was addressing an online press conference, said people do not know where to go to seek justice during the lockdown.

[दिल्ली,चंडीगढ़] न्यायमूर्ति कृष्ण मुरारी होंगे पंजाब+हरि हाईकोर्ट के नए मुख्य न्यायाधीश
पंजाब एवं हरियाणा उच्च न्यायालय को आने वाले दिनों में नया मुख्य न्यायाधीश मिलने वाला है क्योंकि कानून मंत्रालय ने इस पद के लिये न्यायमूर्ति कृष्ण मुरारी के नाम को हरी झंडी दे दी है।
न्यायमूर्ति मुरारी इलाहाबाद उच्च न्यायालय के न्यायाधीश हैं और पिछले महीने सुप्रीम कोर्ट कॉलेजियम ने पंजाब एवं हरियाणा उच्च न्यायालय के मुख्य न्यायाधीश के पद के लिए उनके नाम को मंजूरी दी थी।
हाल ही में न्यायमूर्ति शिवाक्स जाल वजीफदार के सेवानिवृत्त होने के बाद न्यायमूर्ति अजय कुमार मित्तल पंजाब एवं हरियाणा उच्च न्यायालय के कार्यवाहक मुख्य न्यायाधीश नियुक्त किये गये थे ।

The top court held that live-in relationships were now even recognized by the Legislature and they had found a place under the provisions of the Protection of Women from Domestic Violence Act, 2005.
The observations came while the apex court was hearing a plea filed by one Nandakumar against a Kerala High Court order annulling his marriage with Thushara on the ground that he had not attained the legal age of marriage.

[New Delhi]High Court,Modifying Own Verdict,Says”No”For Street Vendors In Non Hawking Zones
Delhi High Court Said Vendors can’t sell items in non-hawking zones
Delhi High Court today said that street vendors cannot sell their wares in areas which were identified as non-hawking zones under the earlier schemes on street vending.
The court modified its September 9 order that said no street vendor should be evicted from city roads without following due process of law.
A bench of
Chief Justice G Rohini and
Justice Sangita Dhingra Sehgal
said it was modifying its September 9 order as the aspect of non-squatting zones were not inconsistent with the 2014 Protection of Livelihood and Regulation of Street Vending Act which prohibits vending activities in non-vending areas.
The court noted that though the Act came into force on May 1, 2014, “there were several lapses in proper implementation of its provisions and consequently, no vending zones have not yet been declared”.
“Having regard to the fact that declaration of non-squatting zones or non-vending zones is not inconsistent with provisions of the Act of 2014, which expressly prohibits carrying out vending activities by street vendors in non-vending zones,..
The observation came while denying NDMC’s plea that it be allowed to go ahead with its survey of street vendors as provided under the Act.
“Unless we can decide if there can be more than one scheme, we do not want to decide NDMC plea,” the bench said.

India has 18 judges per ten lakh people Instead Of 50 recommended by the Law Commission in its 1987
According to the data put out by the Law Ministry in public domain, the judge to population ratio in India stands at 17.86 judges per 10 lakh people.
Mizoram has the highest judge to population ratio which stands at 57.74.
In Delhi, it stands at 47.33,
while in Uttar Pradesh, the most populous state of the country, the ratio is 10.54 judges per 10 lakh people.
West Bengal has the lowest judge to population ratio at 10.45 judges per 10 lakh people.
The sanctioned strength of the Supreme Court today stands at 31 judges, including the CJI as compared to 25 in 2009.
The apex court faces a shortage of 3 judges. Four new judges were recently appointed to the apex court.
The sanctioned strength of the high courts till 2014 was 906 judges and it was increased to 1,079 in June this year.
There are 24 high courts in the country.
But despite the increase in the sanctioned strength, the high court, as in July this year, faced a shortage of 477 judges.
The subordinate courts in the country, the backbone of justice delivery system, have a sanctioned strength of 20,502.
But there are only 16,070 judicial officers serving in the courts and the shortage stood at 4,432 as on December 31, 2015.
Addressing the inaugural session of Joint Conference of Chief Ministers and Chief Justices of High Courts here in April, CJI T S Thakur had said since 1987, when the Law Commission had recommended an increase in the number of judges from then 10 judges per 10 lakh people to 50, “nothing has moved”

Delhi HC Judges Shuffled

[New Delhi] Delhi HC Judges Shuffled
Two judges of the Delhi High Court —
[1]Justice Suresh Kumar Kait and
[2]Justice Rajiv Shakder —
were today transferred to the High Courts of Andhra Pradesh-Telangana and Madras respectively.
A Law Ministry statement said here that Justice Kait has been transferred to the High Court of Telangana and Andhra Pradesh and directed to assume charge of his office on or before April 15.
Similarly, Justice Shakdher has been posted to the Madras High Court and directed to assume charge on or before April 15.
The statement also said Justice Kaushal Jayendra Thaker, Additional Judge of the Gujarat High Court has been transferred as an Additional Judge of the Allahabad High Court.

Former Chief Justice Of India YK Sabharwal[73] Passed Away:Cremation today

[New Delhi]Ex-CJI YK Sabharwal Passes Away:Cremation today.
Former Chief Justice of India Y K Sabharwal passed away here last evening.
73-year-old Justice Sabharwal is survived by two sons Chetan and Nitin. The cremation will take place today.
Justice Sabharwal was CJI from November 1, 2005 to January 13, 2007.
Justice Sabharwal delivered several important judgements including the verdict in January 2006, that held the dissolution of Bihar Assembly as illegal and unconstitutional.
