केंद्रीय सूचना एवं प्रौद्योगिकी मंत्री कपिल सिब्बल ने कहा कि सरकार आईटी कानून के दुरूपयोग करते हुए गिरफ्तारियां न की जाएं.
श्री सिब्बल ने राज्यसभा में प्रश्नकाल के दौरान अनुपूरक प्रश्नों के जवाब देते हुए कहा कि हम जल्द ही राज्य सरकारों को परामर्श भेजेंगे कि निरीक्षक या उपनिरीक्षक स्तर के अधिकारी वरिष्ठ स्तर के अधिकारियों से किसी आदेश के बगैर आईटी कानून की धारा 66(ए) का उपयोग न करें.
आईटी अधिनियम की धारा 66(ए) में इलेक्ट्रॉनिक मेल के जरिए अप्रिय संदेश भेजने के लिए दंड का प्रावधान है. इस मामले में दोषी व्यक्ति को तीन वर्ष कारावास या जुर्माने की सजा हो सकती है.
आईटी अधिनियम की धारा 66(ए) को लेकर उस समय काफी होहल्ला मचा था, जब फेसबुक पर एक पोस्ट के लिए मुम्बई के निकट ठाणे में दो लड़कियों को गिरफ्तार कर लिया गया था. इन लड़कियों ने शिव सेना प्रमुख बाल ठाकरे के निधन के बाद शहर में बंद के आयोजन पर सवाल खड़े किए थे. बाद में इन लड़कियों को रिहा कर दिया गया था.
इस घटना के कुछ दिनों बाद महाराष्ट्र के पालघर में पुलिस ने महाराष्ट्र नवनिर्माण सेना के प्रमुख राज ठाकरे के खिलाफ फेसबुक पर एक पोस्ट के लिए एक 19 वर्षीय लड़के से पूछताछ की थी.
श्री सिब्बल ने कहा कि यह मेरी निजी राय और सरकार का रुख है कि ये गिरफ्तारियां उचित नहीं थी. अभिव्यक्ति की आजादी सबका मौलिक अधिकार है. इसलिए हम राज्य सरकारों से यह भी आग्रह कर रहे हैं कि आईटी अधिनियम के प्रावधानों के इस्तेमाल के बारे में क्रियान्वयन एजेंसियों को शिक्षित किया जाए|
